KAARUKRITI STANDARD TERMS AND CONDITIONS OF SALE
1. Definitions
- Buyer: The individual or entity purchasing goods from Kaarukriti.
- Seller: Kaarukriti, the entity providing goods.
- Goods: Any product or item sold by Kaarukriti.
- Order: The request for goods made by the Buyer.
2. Acceptance of Terms
- By placing an order with Kaarukriti, the Buyer agrees to be bound by these Terms and Conditions.
- Any modifications to these terms must be agreed upon in writing by both parties.
3. Orders
- All orders are subject to acceptance by Kaarukriti.
- The Buyer must provide accurate information for the order. Kaarukriti is not liable for errors arising from incorrect or incomplete information.
4. Price and Payment
- Prices are subject to change without prior notice, except for confirmed orders.
- Payment terms are as specified on the invoice. Payment must be made in full by the due date specified.
5. Delivery
- Delivery dates provided are estimates only. Kaarukriti will not be liable for delays beyond reasonable control.
- Title and risk of loss for goods pass to the Buyer upon delivery.
- The Buyer is responsible for inspecting the goods upon delivery and notifying Kaarukriti within 2 days of any defects or discrepancies.
6. Returns and Cancellations
- Goods may only be returned if they are defective or not as per the order.
- The Buyer must obtain a return authorization from Kaarukriti before returning any goods.
- Cancellations must be made in writing and are subject to approval. Custom or made-to-order products may not be canceled once production has begun.
7. Warranty
- Kaarukriti warrants that the goods will be free from material defects for a period of 6 Months from the date of delivery.
- Any claim for defects must be submitted within the warranty period.
- This warranty does not cover normal wear and tear, misuse, or accidental damage.
8. Limitation of Liability
- Kaarukriti’s liability for any claim related to the sale of goods is limited to the purchase price of the goods in question.
- Kaarukriti will not be liable for any indirect, incidental, or consequential damages arising from the sale or use of the goods.
9. Force Majeure
- Kaarukriti will not be liable for any failure to fulfill obligations due to events beyond its reasonable control, including but not limited to acts of God, war, strikes, or supply chain disruptions.
10. Governing Law
- These Terms and Conditions are governed by the laws of Hyderabad.
- Any disputes will be resolved in the courts of Hyderabad.
11. Severability
- If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.
12. Entire Agreement
- These Terms and Conditions, together with any order confirmation or invoice, constitute the entire agreement between Kaarukriti and the Buyer and supersede any prior agreements or understandings.
